Terms and Conditions of Use

The Hornemann Institute has now added E-Publication to its website, a platform that enables authors and institutions to publish their texts, posters and videos for the preservation of cultural heritage free of charge and, for the most part, independently. Users are able to access these works free of charge and to download them without the need for prior registration.
The Hornemann Institute supports a policy of “open access” to promote the exchange of thoughts and ideas in the scientific community. Open access means that scientific literature is available to the general public free of charge on the internet. In this context, the Hornemann Institute acts as the provider and cedes the respective authors the rights to and control over their own works. We would like to make sure that your achievements and findings are made public, duly recognized and quoted appropriately.

These Terms and Conditions of Use regulate the provision of information and works (university theses, essays, videos, etc.) by the author/s and institutions (hereinafter referred to as “Author/s” and the access to them by the general public (hereinafter referred to as “User/s”).
We are happy to help you publish your works! These Terms and Conditions of Use also apply in cases in which we provide you with technical support or with help in organization.

Registration for Author/s
Registering and creating a user account is the prerequisite to being able to publish your work. In doing so, you agree to the following Terms and Conditions of Use. You are required to register only once, whereby you agree to fill out the registration form completely and truthfully and to keep this information up to date.
Author/s are responsible for ensuring that their access information is not abused, i.e. that no unauthorized persons have access to the user account.

User Accounts for Author/s
The information you enter in the database and any files you upload to the server can be accessed via your user account for an unlimited period of time. As such, you have unlimited access to any information and works published under your name, insofar as the latter have not been linked to a DOI, a Digital Object Identifier (see below). As the author, you agree to allow your works to be made available to the general public, but are entitled to withdraw any of your works from publication at any time. However, it must still remain possible to allocate the authorship of any works that continue to remain available accordingly.
Please ensure that any contents you upload are free of viruses, worms, Trojans or any other programs that could endanger or negatively affect the functionality of the website or the computers of the users.
Author/s are not permitted to upload contents that pursue commercial interests, advertising in particular. A pertinent web address may be included in the contact data, as this can facilitate and promote the exchange of thoughts and ideas in the scientific community.

To ensure the error-free output of the database contents on the Hornemann Institute website and for user administration, the HAWK reserves the right to access user accounts and the right to block or delete, in part or in full, any and all of the information and files published.

Deleting a User Account and its Contents
Author/s can request the information and files they have entered into the system to be deleted in full at any time. Withdrawing the publication of a work with a Hornemann Institute DOI is possible only in exceptional cases, e.g. if a third party has legal claims to the publication. In this case, please contact us as soon as possible.

Transfer of User Rights and Choice of Licenses
All user rights to the works offered via E-Publication remain the property of the Author/s and/or the persons and institutions authorized to publish said works.
As an author, you ensure that you are authorized to grant the user rights indicated here of the works published via E-Publication, also with regard to any third-party texts and/or illustrations contained therein. You also ensure that you are responsible for the contents of the works made available for publication and that their publication does in no way infringe on any legal regulations or the rights of third parties.
Author/s grant the HAWK the basic right, unlimited by location and time, to duplicate, permanently electronically store and make publicly available via the internet the information and files provided by them, including the descriptive data (metadata) on a HAWK server.
In addition, they grant the HAWK the right to make the metadata of the works on the server available to other specialist and scientific databases and to advertise the publication of such works, among other things, via social media services (Facebook, Twitter, LinkedIn, Google+). Metadata contains the main information on a work (name of the author/s, title, abstract, if applicable, year of publication, institution and place) as well as information on the license and the file format.

Insofar as not otherwise indicated, the works are offered under the Creative Commons BY-NC-ND 3.0 Germany license. Author/s may also choose other licenses, insofar as these grant the User/s more rights: The license chosen by the Author/s and indicated in the data set shall apply.

Liability Exemption
You are required to inform the Hornemann Institute without delay whenever any real or alleged claims are made by third parties as a result of the publication of your contents. Author/s who make works available on this platform exempt the HAWK from any liability whatsoever due to claims made by third parties of an infringement on their rights on the basis of the contents made available by the Author/s. In addition, you agree to assume any and all costs incurred by the HAWK due to a third-party claim for which you are responsible.

Disclaimer for Author/s and the HAWK
There is no guarantee provided for the contents published on the website of the Hornemann Institute. Any data uploaded or downloaded is done so at the User/s’ own risk. Author/s and the HAWK do in no way guarantee that the contents provided will meet the requirements of the database User/s. Neither the Author/s nor the HAWK shall be liable in the event of any damages incurred as a result of the use of the works provided or the contents described therein.
The HAWK does not guarantee any particular database functionalities for the Author/s and the User/s. Some data sets may contain third-party links (hyperlinks) to web pages operated by other providers, for whose contents neither the HAWK or the Author/s shall be liable. Should the Hornemann Institute become aware that a linked web page contains contents that are illegal, this link will be removed as quickly as possible.

Data Privacy
The Notes on Privacy Protection of the HAWK University of Applied Sciences and Arts Hildesheim/Holzminden/Goettingen shall apply.

Notes on Secondary Publication Rights
Secondary publication rights for academic texts are legally anchored in German law: According to this, “the author of a scientific contribution which results from research activities at least half of which were financed by public funds and which was reprinted in a collection which is published periodically at least twice per year also has the right to make the contribution available to the public upon expiry of 12 months after first publication in the accepted manuscript version, unless this serves a commercial purpose”, even if he has granted the publisher or editor an exclusive right of use. The source of the first publication must be cited. (cf. Section 38 Para. 4 Act on Copyright and Related Rights – Urheberrechtsgesetz – UrhG).
